ANALISA HUKUM PENUNDAAN KEWAJIBAN PEMBAYARAN UTANG DITINJAU BERDASARKAN UNDANG-UNDANG NOMOR 37 TAHUN 2004

Abstract

This research is structured because the postponement of debt payment obligations is one of the choices often taken by both debtors and creditors as an effort to restructure debt. However, many do not understand what the Delay in Payment of Debt actually means is analyzed from a legal perspective. This study aims to determine the procedure for the implementation of Postponement of Debt Payment Obligations in terms of Law Number 37 of 2004 concerning Bankruptcy and Suspension of Debt Payment Obligations and the legal consequences of implementing Debt Payment Suspension to creditors, to debtors, and to debts.
This research uses empirical juridical and normative juridical approaches, through library research to obtain primary and secondary data. In library research, literature studies are carried out on laws and regulations and other literature studies.
